By now everyone who pays attention to politics in Wisconsin, knows that activist Judge Rudolph Randa , has ordered an end to the John Doe 2 probe. The Wisconsin republican party spent the weekend championing "states rights" at their convention, even going so far as to vote for Wisconsin to secede from the rest of the United States. Then spent Monday running to a Federal friendly Federalist Society Judge to have him overturn a local investigation.
While this move is disappointing it is not surprising. Former US Attorney Steve Biskupic, really did his job well as the attorney for "friends of scott walker" by getting Activist Judge Randa to stop the investigation into their money laundering.
Of course, the chances for a successful outcome are increased tremendously when your wife is the "Judicial Assistant" for the Judge you are appealing to.(H/T Graeme Zielinski for pointing out the family ties).
Rules/SCHMules :
28 U.S.C. sec. 144, captioned "Bias or prejudice of judge," provides that under circumstances, when a party to a case in a United States District Court files a "timely and sufficient Motion that the judge before whom the matter is pending has a personal bias or prejudice either against him or in favor of an adverse party," the case shall be transferred to another judge.
Wow and the plot thickens................how dirty can politics and justice get before the FEDS take notice and come take a look.

ReplyDeleteGovernor Doe reportedly was euphoric at the prospect of avoiding a stay at a Federal Pound Me In The Ass Prison. The euphoria reportedly evaporated as the order was stayed before the Farenheit 451 historians could have their way with the records they hadn't already been able to save from history (aka destroy.)
The irony of the ordered destruction of documents and records produced by an alleged investigation into (allegedly) the same acts by members of the Doe administration was lost on the governor and his butt puppet minions. "I am a man of facts not speculation and innuendo" stated Governor Doe. Governor Doe blamed the investigation on "possible anti-Koch type infiltrators and potential atheist muslims and their allies hiding behind the deep pocketed democrat labor axis of evil. These people may be infiltrating our state for their own purposes. Be on the lookout for those who sing sings and don't attend church regularly!"
