Cindy Archer Loses Again!

For those that do not remember her, Cindy Archer, was one of Scott Walker's cronies.   Archer was one of the people in Scott Walker's inner circle who was in on the private server that Scott Walker set up in his County Executive office. so the taxpayers of Milwaukee County could pay his campaign staff!  

Archer was also one of the minor minds behind ACT10, but did her best to perpetually play the victim.  However, while she was keeping quiet and covering for her boss - John Doe - Scott Walker, her boss was doing a quid pro quo and kept moving her around, with monster raises, to different Wisconsin Government jobs.  She had to keep moving because she was never qualified for any of them, too long in one place would show her incompetence.

One morning, the police knocked on her door, served a search warrant and seized some of her personal items.   The problem is the main millionaire Eric O'Keefe, is apparently a relative of Doug and Wendy Whiner.  

While O'Keefe was using his money to whine about his treatment all over the country, his gophers like Matt Kittle was repeating the BS.  While the "reporters" who called the John Doe probe a political witch hunt, set back journalism and the truth a millennium, but is the best way to stay employed in the Wisconsin right wing.

Cindy Archer, never one of the brightest bulbs on the tree, actually believed the Kittle propaganda and filed suit against DA John Chisholm and others.    Frivolous lawsuits are like an initiation ritual on the right.

Like frivolous lawsuits do, her suit got tossed out quicker than a doggy bag from Ground Round.

With unlimited cash reserves to take their best shot at punishing anyone who would dare question the WisGop, Archer appealed the dropping of the lawsuit to the 7th Circuit Court,

After a good laugh they also dropped the lawsuit.  However there was one difference here than the lower courts ruling.

   The appeals court on Tuesday agreed with that decision in a ruling that said there was no evidence suggesting Archer's support for Walker played a role in the investigation. The court similarly disagreed with her claims that she was subjected to an illegal search."Unpleasant as the events undoubtedly were, we see nothing objectively unreasonable in what occurred," Wood wrote of the early-morning raid of Archer's home.
Joining Wood in Tuesday's ruling were Judges William Bauer and Ilana Rovner.
Wood was appointed by Democratic President Bill Clinton; Bauer by Republican President Gerald Ford; and Rovner by Republican President George H.W. Bush.
The judges also sided with a part of Adelman's ruling that allowed the federal court to hang onto documents investigators gathered as part of a probe of Walker's campaign known as John Doe II.
That probe was conducted under the John Doe law that at the time allowed prosecutors to operate in secret and compel targets and witnesses to turn over their records. The state Supreme Court shut down that investigation in 2015, saying nothing illegal had occurred.

Two courts both said we need to keep all of the records of John Doe just in case.   The Bought and Purchased five on the Wisconsin Supreme Court tried to get them to destroy all of the evidence of Scott Walkers criminal wrongdoings.  

Luckily, outside of Wi, there is an actual independent judiciary.

The question is now what is next for CIndy Archer?     WIll she be appointed to another state job, with another raise?   Will she file yet another lawsuit?   Will she retire with her partner off the State Pension she has accrued??    Hopefully she uses her Government supplied healthcare to get her delusions of grandeur taken care of!


PS:  A blast from the past.  It was Cindy Archer that sent an email to Scott Walker and convicted felon Kelly Rindfleisch to fire our very own Capper!   If we could mine irony, we would be the richest state in the Universe.

No! I do not mean KellyAnne Conway, for using a private RNC email system while in the White House.  Unsecured private emails being hacked was a worry of 2016, in 2017, we no longer have to worry about Russian hackers(they have too good of friends in the White House to hack their emails).

No!  I do not mean Deborah Jordahl.   That poor lady has suffered enough.  All she wanted to do was cash in for her clients with our Government and not be held accountable for anything or transparent about anything.   Then the crazy Dems had to go ahead and ruin it by actually thinking that our public servants needed to operate out in the open.  Ms. Jordahl does not need to be prosecuted she is already sentenced to living in a half million dollar house in Middleton.   The horrors.  

No I don't mean Kelly Rindfleisch, she is already locked up!

I am talking about any woman who has an abortion(no matter what) and any healthcare provider who helps perform the procedure!

A Republican lawmaker in Texas who proposed a bill that would criminalize abortion said the policy would force women to be “more personally responsible” for their sexual behavior.
“Right now, it’s real easy,” State Rep. Tony Tinderholt (R) told the Texas Observer. “Right now, they don’t make it important to be personally responsible because they know that they have a backup of ‘oh, I can just go get an abortion.’ Now, we both know that consenting adults don’t always think smartly sometimes. But consenting adults need to also consider the repercussions of the sexual relationship that they’re gonna have, which is a child.”
Tinderholt’s bill, the Abolition of Abortion in Texas Act, would ban abortion at every stage of pregnancy and amend the state’s penal code to allow women and providers to be charged with murder for the procedure. The bill has no exceptions for rape or incest, because Tinderhold said he doesn’t think “there should be any exceptions to murder, no matter what.” 

Yes this is Texas, but we all know that there are organizations that drive GOP controlled State Legislatures and when one state gets going on a bill like this, there are others that try and out crazy their peers (see Bill, Bathroom).  How long until Jesse Kremer tries to one up him?

Elections have consequences!   When people put Republicans in charge because Democrats "need a safe space" or numerous other ridiculous reasons, then we must be prepared to live under the rule of the people we put in office.  

My best suggestion at this point, is try and move close to a prison so you can visit the people you know who have had an abortion or might need one in the future.  

I also look forward to our society in a few years when children of incest, who were not allowed to be aborted, start growing into adulthood!

Gableman Backs Down

On Tuesday morning, I wrote at Cog Dis and Crooks & Liars about how Wisconsin Supreme Court Justice Michael Gableman wanted to revisit an appeal by former Walker aide Kelly Rindfliesch. Rindfleisch was convicted of doing illegal politicking while working for Scott Walker when he was Milwaukee County Executive.

I also pointed out that Gableman's unprecedented request was a huge conflict of interest.

In what I am sure is pure coincidence, Gableman rescinded his request on Tuesday afternoon:

Justice Michael Gableman last week took the unusual step of asking his colleagues to reconsider that decision and take up her appeal. But on Tuesday, Gableman withdrew his request.

[...]

In a letter to attorneys in the case, Gableman noted that Rindfleisch still had that other avenue of appeal. He didn't address the question of whether he also lacked support among his fellow state justices for his request.

"Her appeal is now pending before the United States Supreme Court where, among other things, she will have the benefit of review by the entire court," Gableman wrote of Rindfleisch. "I believe that is the better course of action at this time, and therefore withdraw my motion."

Now Scott Walker and his dark money supporters are going to have to find a new way to kill off the John Doe investigation if they don't want it raising its ugly head while Walker is running for president. Because, let's face it, if they can't do their illegal collaboration and buy elections, what chance do these fools stand in a fair election?

A Supreme Conflict Of Interest

As previously reported, Kelly Rindfleisch, a former aide to Scott Walker when he was Milwaukee County Executive, was charged and convicted of illegal politicking during government time and using government equipment. She appealed the proceedings and subsequent conviction numerous times to no avail. One of her latest appeal attempts went to the Wisconsin Supreme Court, which declined to hear her case on a 6-0 vote (Justice David "Choke hold" Prosser recused himself.) Rindfleisch is now almost halfway through "serving her sentence." (More on that later.)

Rindfleisch has since made an appeal to the United Supreme Court, continuing her argument that the subpoenas were too broad and too vague and thus unconstitutional. She hasn't won on that argument yet, but what they hey?

Following that, Wisconsin Supreme Court Justice Michael Gableman, one of the four corporate-controlled conservative justices, in an unprecedented move, asked his fellow justices to consider revisiting the Rindfleisch appeal:

On Thursday, a memo was filed from Gableman asking that the high court revisit the issue when it next meets in private. He did not explain why he wants to take the issue up in his one-paragraph memo.

Such a move is highly unusual, if not unprecedented. The original decision not to take the case was agreed to by all the justices except David Prosser, who did not participate in the case.

At first glance, the gentle reader might suspect that Gableman's unusual and questionable request came as a favor to one of his main benefactors, Wisconsin Club for Growth (WCfG). WCfG has a number of cases pending before the Wisconsin Supreme Court regarding the John Doe investigation into the illegal collaboration between them and Scott Walker.

If WCfG could pull some money strings and get the Supreme Court to overturn Rindfleisch's conviction, this would set a precedent and give strength to their own cases.

To strengthen one's suspicions, one of the dark money propaganda groups, which has written over 200 articles about Rindlfeisch and labels her a "political prisoner," has revealed that Rindfleisch, who was given work release privileges from her home confinement (talk about doing hard time!), is working for Eric O'Keefe, the head of WCfG:

A deputy in Sauk County’s Huber, or work release, division, confirms that Rindfleisch is being monitored with an ankle bracelet and living with her sister in Sauk County. She is confined to the home, but has Huber privileges, including the right to work.

Rindfleisch is working for none other than Eric O’Keefe, the long-time conservative activist who has filed multiple lawsuits against Chisholm and two of his assistants alleging prosecutors trampled conservatives’ First Amendment rights with their politically charged John Doe investigations.

Wisconsin Watchdog has confirmed that Rindfleisch works for O’Keefe’s E&L Corp., a Spring Green-based company that O’Keefe has operated since 1993.

Rindfleisch, according to the Huber division, is picking up the cost of the monitoring device, at $17 a day.

O’Keefe, director of the limited-government group Wisconsin Club for Growth, has come to the defense of Rindfleisch, who was convicted in 2012 on a nebulous charged of misconduct in office. Rindfleisch served as deputy chief of staff for Walker when Walker was Milwaukee County Executive.

So, the former Walker aide who was convicted of illegal politicking ends up working for a Walker ally who is under investigation for illegal collaboration with Walker. And now, a Supreme Court Justice, who has ethical issues that he is still under investigation for and who has received financial support from WCfG, wants to reopen a case he originally voted not to hear.

Yeah, nothing to see here, right?

The real kicker is that if these four conservative justices, including Gableman, had even a modicum of ethics themselves, they would have already recused themselves from all of these cases due to their own conflicts of interest, as the Supreme Court of the United States had already ruled.

MILWAUKEE -- Governor Walker's former deputy chief of staff will report to prison later today. 

 

Kelly Rindfleisch worked for the governor while he was Milwaukee County Executive.

 

She was sentenced to six months for fundraising for a Lieutenant Governor candidate while on the clock for the county.

 

I love when true criminals get to pay their penance.   

John Doe joins Scott Walker's presidential campaign

The original John Doe investigation into Scott Walker and his staff, commonly referred to as Walkergate, resulted in six people close to Walker being convicted on assorted crimes.

One of the most prominent of those arrested and convicted was Kelly Rindfleisch, who Walker hired to be his deputy chief of staff while he was Milwaukee County Executive. Based on the emails and other court documents, Rindfleisch's primary responsibility was to do fundraising for Walker and Brett Davis, who Walker wanted to be his lieutenant governor.

Rindfleisch was convicted of misconduct in office in a plea deal. Even though her sentence was a slap on the wrist, she immediately appealed her conviction. When she lost her appeal, she appealed it to the Wisconsin Supreme Court.

The Supreme Court has now also rejected her appeal:

The state Supreme Court has rejected an appeal from a former aide to Gov. Scott Walker when he was Milwaukee County executive.

Kelly Rindfleisch, who was convicted of misconduct in office for doing campaign work while at her county government job, had appealed her conviction to the state's highest court in December.

The move came after a state appeals court upheld her conviction in November, when a three-judge panel rejected her argument in a 2-1 decision.

On Monday, the Supreme Court denied her petition. Justice David Prosser did not participate.

This decision has significance on several different levels.

First, it means that Rindfleisch will finally have to pay her debt to society for her crimes and have to serve her six-month jail sentence and three years of probation. She will be the third person convicted out of the Walkergate investigation that will have spent time behind bars.

Secondly, despite his protests to the contrary, Walker knew full well about the secret email system and the illegal activities his staff were conducting. Hell, he was directing them.

Thirdly, it should be noted that Walker knew that this would be damaging to him, which led him and his friends to fund Rindfleisch's legal defense.

Fourth, the fact that Walker had the audacity of a dope in attacking Hillary Clinton over her supposed email scandal shows just what a hypocrite and weasel Walker really is.

Fifth, it is interesting in itself that the Supreme Court chose not to even hear the matter, especially since Rindfleisch's defense was that the scope of the investigation was too broad. This is the same argument being used in the John Doe cases that the Supreme Court will be hearing later this year.

In the same sense, it is worth noting that Justice David Prosser did not participate in the decision. While it could be that he was on vacation or out practicing his choke holds, it could also be that Prosser is tied in with Rindfleisch. We do know that Prosser had questionable activities happening on his most recent reelection.

With all the other gaffes and missteps that have been plaguing Walker and his campaign, the last thing he wanted was to have this reminder of the corruption he oversaw popping up. Personally, I don't think that it could happen to a more deserving person.

Walkergate: Kelly Rindfleisch Asks John Doe To The Big Dance

Kelly Rindfleisch, one of Scott Walker's top aides who pleaded guilty to illegally doing political work while on county time, is appealing her conviction.  Again:

A former aide to Gov. Scott Walker when he was Milwaukee county executive has appealed her conviction for misconduct in public office to the Wisconsin Supreme Court.

Kelly Rindfleisch filed the appeal on Friday. It comes after a state appeals court on a 2-1 vote upheld her conviction last month.

Rindfleisch was one of six people convicted as a result of a now-concluded “John Doe” investigation focusing on activities in Walker’s county executive office. Walker was never charged.

Rindfleisch had pleaded guilty to felony misconduct in office in October 2012 for doing campaign fundraising for then-lieutenant governor candidate Brett Davis during the time she was receiving a county paycheck.

Her appeal is based on investigators’ seizure of roughly 16,000 emails from her Yahoo and Google accounts. She argues on appeal that the emails were obtained during an unconstitutional search and should be suppressed.

Keep in mind that she appealed this issue during her trial and appealed her conviction on this matter.

She is obviously hoping to do a Scott Jensen-like maneuver in getting the case in a friendly venue where the rule of law is not as important as the rules of their corporate overlords.

I also find it ironic that Rindfleisch keeps crying about how broke she is but keeps finding the money to pay high-end Attorney Frank Gimbel to file these frivolous appeals.  Then again, she's probably getting a discount rate since Gimbel is a big supporter of Walker, who is helping pay for Rindfleisch's legal defense fund.

Walkergate: Rindfleisch's Desperation Defense

Even though Kelly Rindfleisch had pleaded guilty to doing campaign work while on work time for Milwaukee County, she appealed her conviction.  After months of delay tactics in which she failed to stall the release of the emails and documents used to convict her, she finally had her day in appellate court.

In a nutshell, Rindfleisch argued - through her mouthpiece Frankly Gimbel, who she paid with funds raised by Scott Walker and company - that her guilty plea should be overturned because the search warrant was too broad and violated her Fourth Amendment Rights and her privacy.  She also argued that the prosecutors should have used a third party to filter through the emails that they had taken.

The state, represented by Assistant Attorney General Christopher Wren, pointed out that the investigators sought a very specific, albeit large, group of emails and not any other information that the email companies might have gathered from Rindfleisch.

Paid propagandist M.D. Kittle, who quickly rattled off a spin defense, shows how nervous the right wing is about this:

When the hour-long oral arguments concluded, however, Gimbel said he was “insecure” that he and the appeals court were focusing on the same issues.

That means Gimbel was afraid that the judges were going to look at all the facts and not just his Hail Mary defense tactics.

Kittle further belies their nervousness by starting to smear the judges.

There are two major points that both the mainstream media's report and Kittle's panicky prose both miss.

One, Rindfleisch's appeal should be denied because their argument is based on the faulty premise that Rindfleisch was targeted because of political reasons.

The fact is that the John Doe investigation known as Walkergate started as an investigation in whether money was stolen from a veterans' fund.  That investigation led to emails that showed a secondary crime - illegal politicking - had been committed.

It was the evidence from Tim Russell's emails that led to this new investigative trail that led to the arrest, charging and conviction of Rindfleisch.  She only became a target after investigators found the crime and learned that she was one of the people committing said crime.

The second point is one that will stand true regardless of what the appellate court decides.

There is not one person - not even Rindfleisch or her attorney or anyone else - who is saying that she is innocent and did not commit the crime that she was convicted for.  Her defense is that the prosecutors shouldn't be allowed to use the evidence that they legally found and used against her, but not that she didn't commit the crime.

Whether Rindfleisch is able to pull off a Scott Jensen maneuver of buying her way off the hook through a technicality has yet to be seen.

But either way, we know that Walker and his crew were running a caucus style campaign through the county executive's office, just as they are doing now from the governor's office.

NBA -2 / WI - 0!

For those who have not been paying attention to the NBA, one of the owners, Donald Sterling went off on a racist rant to his girlfriend.   The result of this rant caused much uproar within the NBA community and the sports world as a whole.

Embattled Los Angeles Clippers owner Donald Sterling has lost his bid to block the $2bn (£1.18bn) sale of the team to former Microsoft CEO Steve Ballmer.

The deal has been negotiated by Mr Sterling's estranged wife Shelly Sterling.
Mrs Sterling said she had taken over the family trust that owns the team because doctors found Mr Sterling had signs of Alzheimer's disease and could not manage his affairs.
He sought to block the sale, saying his wife had deceived him about the medical exams and at one point calling her a "pig" in court.
The 80-year-old billionaire was banned by the National Basketball Association after he made offensive remarks about black people.
 The saga began in April when a recording surfaced of Mr Sterling scolding his young girlfriend for bringing black men to Clippers games.
The NBA moved quickly to ban him for life and fined him $2.5m (£1.4m).

Recently, the NBA had to deal with a similar situation as the owner of the Atlanta Hawks was busted sending a racist intra-office email to his fellow executives of the team.   

For the second time this year, the owner of a professional basketball team will sell his controlling interest of a franchise after his racially insensitive views were made public.

Bruce Levenson, who has led the ownership group of the Atlanta Hawks since 2004, informed N.B.A. Commissioner Adam Silver on Saturday that he intended to sell the team, effectively cutting short a league investigation into an email that Mr. Levenson sent two years ago to fellow Hawks executives detailing his thoughts on how the team could attract more white fans.

On Sunday, when the issue came to light, the Hawks released the text of the August 2012 email, in which Mr. Levenson speculated that the team’s black fans had “scared away the whites” and that there were “not enough affluent black fans to build a significant season ticket base.”

“I think Southern whites simply were not comfortable being in an arena or at a bar where they were in the minority,” Mr. Levenson said in his email, pointing out that he had earlier told the executive team that he wanted “some white cheerleaders” and “music familiar to a 40-year-old white guy,” and that he thought “the kiss cam is too black.”

 Mr. Levenson knew what he wrote was wrong and the NBA jumped in immediately to do damage control.

“If you’re angry about what I wrote, you should be,” he said. “I’m angry at myself, too. It was inflammatory nonsense. We all may have subtle biases and preconceptions when it comes to race, but my role as a leader is to challenge them, not to validate or accommodate those who might hold them.”

Mr. Silver, the commissioner, responded in a statement, “As Mr. Levenson acknowledged, the views he expressed are entirely unacceptable and are in stark contrast to the core principles of the National Basketball Association.”

 Yes it is the year 2014, yes racism is still there and yes people are still emailing racist emails and having racist conversations in private.  Most of us know it is not OK.   Most of us know there is no place for that in our society.

 The NBA gets it.    The State of Wisconsin and the republican party do not!

In the document dumps of Scott Walker's emails (#Walkerdocs), we have found many racist and disgusting emails. 




All sent intra-office emails(on Government taxpayer funded email systems) from Walker Chief of Staff Tom Nardelli to Kelly Rindfleisch and copied to an unknown recipient list(which all signs point to Scott Walker being included on).

Apparently sending enough racist jokes to the Walker troops makes one a great public service.    One thing different about Nardelli though, is that he was an equal opportunity smearer.

I am perplexed that so many are against a mosque being built near Ground Zero. I think it should be the goal of every American to be tolerant. The mosque should be allowed, in an effort to promote tolerance.
That is why I also propose, that two gay nightclubs be opened next door to the mosque thereby promoting tolerance within the mosque. We could call the clubs "The Turban Cowboy" and "You Mecca Me So Hot".
Next door should be a butcher shop that specializes in pork and have an open barbeque with spare ribs as its daily special. Across the street a very daring lingerie store called "Victoria Keeps Nothing Secret" with sexy mannequins in the window modeling the goods.
Next door to the lingerie shop, there would be room for an Adult Toy Shop (Koranal Knowledge?), its name in flashing neon lights, and on the other side a liquor store, maybe call it "Morehammered"

Why would we expect more out of an NBA franchise owner than we do our very own Governor?  Why would the national and local press not demand answers about the racist emails floating around Walkers upper staff?  Who exactly was on the anonymous recipient list?  Did anyone in the Walker inner circle ask to be excluded from the racist emails?  Where are the people in the republican party appalled by this behavior?  Is this the behavior we want our children to model?  have his children followed in his footsteps?  Has anyone ever apologized for this filth?  Are there still racist emails flowing through the inner circle?  What else are they hiding from us?

So many questions met with complete silence by Scott Walker and the people of Wisconsin deserve so much more! 

The Company He Keeps

You can tell a man’s character is known by the kind of company he keeps.

In a recent fundraising email, Scott Walker sent out:

Millions of Americans tune in to hear Rush Limbaugh every week. When he talks, conservatives listen and liberals shudder. He has single handedly revolutionized conservative talk radio and recently he gave us an extraordinary compliment that I want to share with you.
He asked why our political rivals and their friends in the liberal media didn't defeat me in the recall race in 2012 and he said it was because "the reality is he is a hugely successful governor. He has fixed a lot of things that were broken in that state."
In a nutshell, Rush is advancing the argument that the reason the Big Government Labor Bosses and the Obama Machine were unable to beat me is because of our results.

The end of the week in Wisconsin politics brought so much cheap whine to the cheese state that half the population woke up with a headache. 

First from convicted felon Kelly Rindfleisch:

“There were times I felt like I wasn’t going to make it through. They drove me to the absolute depths of depression,” Rindfleisch told Wisconsin Reporter during a recent interview at a diner in downtown Sun Prairie, a Madison suburb.

Ever the victim because she did not bring any of this on herself.  Being wrapped up in two major scandals was pure coincidence.  I feel bad she was so depressed, but no one cares about crazy people.

Jim Villa Lives Up To His Reputation

Readers of CogDis remember the name Jim Villa, he is the Walker Crony who was a hit at ALEC conventions.    Villa was also just appointed to a job that was created just for him within the University of Wisconsin system - Vice President for university relations.  

While there were numerous actually qualified candidates, and the interview team was adamant that Villa NOT be hired,  Jim Villa was hired anyway(surprise, surprise). 

In one email, university official Vicki Keegan, who sat in on the interviews with all five finalists, offered her thoughts to Aaron Brower, the interim chancellor at UW Colleges and UW-Extension. Keegan, the executive director of marketing and enrollment at UW Colleges, listed Villa, along with one other finalist, as unacceptable picks.
"I have other thoughts on this but prefer not to put it in an email," she wrote Brower on March 21. She encouraged Brower to call her back on her cellphone.
Keegan did not immediately respond to an email seeking comment Monday.
Patricia Wanninger, an alumna from Milwaukee, also wrote Cross about her concerns over Villa's hiring.
"The corruption of the once-great University of Wisconsin system is complete, with the appointment of Jim Villa to a disgustingly highly paid, obviously partisan political post," Wanninger wrote. "You will have to put Jim Villa to work grubbing money out of corrupt politicians in Madison, because you won't be getting any more from me."

The Alec superstar Villa, has been handed a job where he is paid well in excess of $200,000/yr(with no experience).  

 

Villa has barely been in the job a month and his first official action proves Ms. Keeganknew exactly what she was talking about! 

A newly hired top-level communications director for the University of Wisconsin System was fired last year as University of Arkansas spokesman following a disagreement over that school's handling of an open records request filed by a newspaper.
The UW System announced Friday that John Diamond had been selected as interim associate vice president for external relations and strategic communications. Diamond was fired in August 2013 by the University of Arkansas from a similar position for insubordination after a confrontation with his direct supervisor.

BUT WAIT, there's more:

 Diamond also claimed that his supervisor at Arkansas, vice chancellor Chris Wyrick, made inappropriate remarks about religion and race and created a hostile and threatening work environment.

Yes, if you are upset over inappropriate racist remarks, the one place you do not want to be is working for Scott Walker!   

In July 2010, then-Milwaukee County Executive Scott Walker’s then-chief of staff, Thomas Nardelli, sent an email to his deputy, Kelly Rindfleisch, and other unknown recipients that consisted of an email forward recounting the story of a “nightmare,” involving waking up black, gay, Jewish, and disabled.
